As part of LoCAR's continuing effort to inform the general public of real estate issues, the following article was submitted to the Morning Journal, The Chronicle-Telegram and LorainCounty.com:

April 2021 marks the 53rd anniversary of the 1968 landmark Fair Housing Act. Each year REALTORS® recognize the significance of this event and reconfirm our commitment to upholding fair housing law as well as our commitment to offering equal professional service to all in their search for real property.

The sale and purchase of a home is one of the most significant events that any person will experience in his or her lifetime. It is more that the simple purchase of housing, for it includes the hopes, dreams, aspirations, and economic destiny of those involved.

In 1968 Fair Housing laws were implemented to eliminate these barriers to home ownership. In 1974 sex and in 1989 the disabled and families with children were included in the protected classes. The Federal Fair Housing Act prohibits discrimination based on race, color, national origin, religion, sex, disability or familial status; but state laws and local ordinances can and often do protect additional classes. In fact, the 2014 REALTOR® Code of Ethics adds gender identity to the list of classes to be protected from discrimination.

And in November 2020, NAR adopted a new standard prohibiting discriminatory speech and conduct: “REALTORS® must not use harassing speech, hate speech, epithets, or slurs based on race, color, religion, sex, handicap, familial status, national origin, sexual orientation, or gender identity.”

REALTORS® help to bring about a real change in the attitude of the housing industry regarding the value and importance of open and free housing.

The responsibility for compliance basically was put on the real estate industry and apartment owners. To real estate professionals, fair housing means equal access, and equal housing opportunities. A person’s ability to rent or own should be limited only by how much he or she can afford.

Fair housing is more than a list of dos and don’ts, rights and penalties, and mandatory continuing education. As stewards of the right to own, use and transfer private property, fair housing protects our livelihood and business as REALTORS® and depends on a free, open market that embraces equal opportunity.

REALTORS® recognize the significance of the Fair Housing Act and reconfirm their commitment to upholding fair housing law as well as their commitment to offering equal professional service to all in their search for real property.

NAR’s Fair Housing Action Plan, abbreviated ‘ACT,’ emphasizes (A)ccountability, (C)ulture Change, and (T)raining in order to ensure America’s 1.4 million REALTORS® are doing everything possible to protect housing rights in America.
