Local Organizations Celebrate 50th Anniversary of the 1968 Landmark Fair Housing

April 2018 marks the 50th anniversary of the 1968 landmark Fair Housing Act. Each year REALTORS® recognize the significance of this event and reconfirm our commitment to upholding fair housing law as well as our commitment to offering equal professional service to all in their search for real property.

In honor of the anniversary of the passing of the Fair Housing Act and in remembrance of the assassination of Reverend Dr. Martin Luther King, Jr., April is set aside as National Fair Housing Month. This year’s annual Lorain County Fair Housing Conference will celebrate the 50th Anniversary of the Fair Housing Act on Thursday, April 12, 2018 from 5:00 – 7:00 p.m., Lorain County Community College Spitzer Conference Center, 1005 N. Abbe Road, Elyria. Registration begins at 4:30 p.m. This is a free event open to the public. Pre-registration encouraged by April 6.

Ms. Darlene Sweeney-Newbern, Director of Regional Operations for the Ohio Civil Rights Commission, Toledo, Ohio will be the keynote speaker on the subject “Same Game, Same Tactics: What has Changed in the Past 50 Years?” Director Sweeney-Newbern has over 28 years’ experience in investigating, supervising and managing employment and fair housing charges for the Commission. She is a popular motivational speaker who has presented at national and international conferences throughout the United States.

The April 12th, Fair Housing Conference is sponsored by the Elyria Fair Housing Board, Lorain Fair Housing Board, Oberlin Human Relations Commission, Lorain County Urban League, Inc. and Elyria Dr. Martin Luther King, Jr. Holiday Commission, and the Lorain County Association of REALTORS®. In 1968 Fair Housing laws were implemented to eliminate these barriers to home ownership. In 1974 sex and in 1989 the disabled and families with children were included in the protected classes. The federal Fair Housing Act prohibits discrimination based on race, color, national origin, religion, sex, disability or familial status; but state laws and local ordinances can and often do protect additional classes. In fact, the 2014 REALTOR® Code of Ethics adds gender identity to the list of classes to be protected from discrimination.

Fair housing is more than a list of dos and don’ts, rights and penalties, and mandatory continuing education. As stewards of the right to own, use and transfer private property, fair housing protects our livelihood and business as REALTORS® and depends on a free, open market that embraces equal opportunity. REALTORS® help to bring about a real change in the attitude of the housing industry regarding the value and importance of open and free housing.

The responsibility for compliance basically was put on the real estate industry and apartment owners. For more than thirty years, REALTORS® have actively been involved in the achievement and promotion of Fair Housing. To real estate professionals, fair housing means equal access, and equal housing opportunities. A person’s ability to rent or own should be limited only by how much he or she can afford.

Based on Federal and State laws, it is illegal:

 To refuse to sell or rent housing based solely on a person’s age, religion, race, creed, national origin, sex or disability.

 To discriminate in the terms or conditions of sale or rental, i.e., requiring a different rent or security deposit.

 To ask questions about a prospective tenant/buyer’s religion, age, race, disability, national origin creed or sex.

 To make a published advertisement which indicates a preference, i.e. couple only, college boys/girls only, Christian individual only, etc.

 To make false claim about the availability of a property when in essence the landlord/seller knowingly states said property to be rented or sold.

 To engage in ‘blockbusting’ or ‘steering’.

 To discriminate in the amount, length, terms or conditions of a loan.
